Terms of Service

Who We Are
GoGuru is a mobile application for private tutors in Sri Lanka, operated by Savith Herath ("GoGuru", "we", "us", "our"). Contact: [email protected].
Data protection contact: For all data protection enquiries — access requests, corrections, deletions, or complaints — contact [email protected] with the subject "Data Protection Request." We aim to respond within 30 days.
Agreement to These Terms
By downloading, installing, or using the GoGuru application or website (gogurulk.app), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use GoGuru.
These Terms constitute a legally binding agreement between you and GoGuru. Please read them carefully.
If you are using GoGuru on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
Who Can Use GoGuru
Tutors: You must be at least 18 years old to create a tutor account. By creating an account, you confirm that you are an adult and that all information you provide is accurate and truthful.
Parents: You must be at least 18 years old to create a parent account. Parent accounts can only be created via an invite link sent by a tutor.
Students: Students are not users of GoGuru. They are data subjects whose information is managed by their tutors within the app. Students do not create accounts and do not interact with the app directly.
GoGuru is currently available only in Sri Lanka. We make no representation that the Service is appropriate or available in other locations.
What GoGuru Does
GoGuru provides private tutors with tools to:
- Manage student profiles and contact information
- Track class schedules and attendance
- Monitor student payment balances
- Log payments received
- Send WhatsApp reminder messages (via the tutor's own WhatsApp account)
- Invite parents to view their child's schedule and payment status
- Manage groups of students for group classes
GoGuru is a management and organisational tool. It is not a payment processing platform and does not handle, facilitate, or guarantee any financial transactions between tutors and students.
Tutor Accounts
Creating an account
To use GoGuru as a tutor, you must create an account with a valid email address and password, or sign in with Google. You are responsible for:
- Providing accurate and complete information when creating your account
- Keeping your password secure and confidential
- All activity that occurs under your account
- Notifying us immediately at [email protected] if you suspect unauthorised access to your account
You may not share your account credentials with anyone else. Each tutor must have their own account.
Account accuracy
You agree to keep your account information up to date. GoGuru is not responsible for problems arising from inaccurate or outdated account information.
One account per tutor
You may only create one tutor account. Creating multiple accounts to circumvent restrictions or exploit the service is prohibited and may result in all your accounts being terminated.
Your Responsibilities as a Tutor
Student data
By entering student information into GoGuru, you confirm that:
- You have a legitimate professional reason to store this information (i.e., you are the student's tutor)
- You have informed the student (or their parent/guardian if the student is a minor) that their information is being stored in a digital application
- The information you enter is accurate to the best of your knowledge
- You will keep student information up to date and delete it when the tutoring relationship ends
For student data you enter into GoGuru, you and GoGuru act as joint controllers. You determine which students' data is entered and what information is recorded. GoGuru determines the technical means by which that data is stored, secured, retained, and deleted. Both parties bear responsibility for ensuring this processing is lawful under Sri Lanka's Personal Data Protection Act (No. 9 of 2022) and other applicable law. As the tutor, you are specifically responsible for ensuring you have a lawful basis for entering each student's data — GoGuru does not and cannot verify this on your behalf.
Parent invites
When you invite a parent to the GoGuru parent portal, you confirm that:
- You have the parent's consent to send them an invite
- The parent's phone number you have entered belongs to the student's parent or legal guardian
- You are not using the invite feature to send unsolicited messages to people who have not expressed interest
Payment records
Payment data you enter into GoGuru is for your own record-keeping purposes. You agree that:
- You will only log payments that actually occurred
- GoGuru payment records are not official receipts or tax documents unless you generate them as such
- You are responsible for maintaining accurate financial records for your tuition business in compliance with Sri Lankan law
Prohibited conduct
You agree NOT to:
- Enter false, misleading, or fabricated information about students or payments
- Use GoGuru to harass, stalk, or threaten students, parents, or any other person
- Use the reminder feature to send spam, unsolicited marketing, or abusive messages
- Attempt to access another tutor's data
- Attempt to reverse-engineer, decompile, or tamper with the GoGuru application
- Use automated scripts or bots to interact with GoGuru
- Resell, sublicense, or commercially exploit GoGuru without our written permission
- Use GoGuru for any unlawful purpose or in violation of any applicable law
- Impersonate another tutor or create a misleading profile
Violation of these prohibitions may result in immediate account suspension or termination.
WhatsApp Reminder Feature — Important Terms
GoGuru includes a feature that opens the tutor's personal WhatsApp application with a pre-written payment reminder message.
You understand and agree that:
- GoGuru does not send messages. GoGuru only opens your WhatsApp app with a pre-filled draft. You are solely responsible for reviewing and sending the message.
- You are sending the message, not GoGuru. Any WhatsApp message sent via the reminder feature is sent from your personal WhatsApp account. GoGuru has no involvement in the transmission of the message.
- You are responsible for compliance with WhatsApp's Terms of Service. Sending unsolicited messages, spamming recipients, or using WhatsApp in ways that violate Meta's terms may result in your WhatsApp account being restricted or banned. GoGuru is not responsible for any action taken by Meta or WhatsApp against your account.
- You must have the recipient's consent. Only send reminders to students and parents who have agreed to receive communications from you about their tuition account.
- GoGuru is not liable for any consequences arising from WhatsApp messages you send, including disputes with students or parents, WhatsApp account bans, or any other outcome.
Parent Portal
Parents who accept a tutor's invite and create a GoGuru parent account agree that:
- They are the parent or legal guardian of the student named in the invite
- They will not share their parent account credentials with anyone else
- They will only use the parent portal to view information about their own child
- Attempting to access another student's data is strictly prohibited and may result in account termination and legal action
Tutors retain full control over the data in their account, including the ability to revoke a parent's access at any time.
Payment and Billing
GoGuru is currently free to use during the beta and initial launch period.
We reserve the right to introduce paid plans in the future. If we do:
- We will give existing users at least 30 days' notice before any free features become paid
- We will offer a free tier with a defined student limit
- Paid plans will be processed through Apple App Store or Google Play Store in-app purchases
- All billing will comply with Apple and Google's respective terms and policies
We will never charge you without clear prior notice and your explicit consent.
Intellectual Property
GoGuru's property
The GoGuru application, website, logo, brand identity, design, code, and all content created by GoGuru are owned by Savith Herath and protected by intellectual property law. You may not copy, reproduce, modify, distribute, or create derivative works from any GoGuru content without our written permission.
Your data
You retain full ownership of all data you enter into GoGuru — student records, payment records, session records, and all other content you create. GoGuru does not claim any ownership over your data.
By using GoGuru, you grant us a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the GoGuru service to you. We will never use your data for any other purpose.
When you delete your account, this licence ends and we will delete your data as described in the Privacy Policy.
Availability and Uptime
GoGuru is provided on an "as is" and "as available" basis. We are a small team and we do not guarantee:
- That GoGuru will be available 100% of the time
- That GoGuru will be free from bugs, errors, or interruptions
- That data will never be lost due to technical failure
We will make reasonable efforts to maintain uptime and recover from any outages or data loss as quickly as possible.
We strongly recommend that you maintain your own backup records of student and payment information. GoGuru should not be your only record of your tuition business finances.
Disclaimers
GoGuru is not a financial services provider. GoGuru does not process payments, hold funds, or facilitate financial transactions. Any payment-related disputes between tutors and students are entirely between those parties and do not involve GoGuru.
GoGuru is not a legal or accounting service. GoGuru payment logs are not official receipts, invoices, or tax records. You are responsible for your own tax and legal compliance as a tuition professional.
GoGuru does not use automated decision-making. No decisions that affect you, your students, or your parents are made by automated systems or algorithms. All data in GoGuru reflects only what you manually enter. GoGuru performs calculations (balance totals, payment summaries) but these are mathematical computations on your own data, not independent decisions about any person.
GoGuru does not verify tutor credentials. We do not verify that tutors are qualified, licensed, or fit to teach. Parents and students must conduct their own due diligence when engaging a tutor. GoGuru bears no responsibility for the quality, safety, or outcomes of any tutoring services.
GoGuru is not responsible for disputes. Any dispute between a tutor and a student, parent and tutor, or any other parties arising from the use of GoGuru is entirely between those parties. GoGuru will not arbitrate, mediate, or take sides in such disputes.
Limitation of Liability
To the maximum extent permitted by applicable law:
GoGuru and its operator (Savith Herath) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data
- Loss of revenue or profits
- Business interruption
- Loss of goodwill
- Any damages arising from your use of or inability to use GoGuru
In no event shall GoGuru's total liability to you exceed the greater of (a) the amount you paid to GoGuru in the 12 months prior to the event giving rise to the claim, or (b) LKR 10,000. This cap applies only to the extent permitted by the law of your jurisdiction — if you are a consumer in a jurisdiction (such as the EU or UK) where consumer protection law requires a higher minimum liability for digital services, that statutory minimum governs.
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence,
- fraud or fraudulent misrepresentation,
- gross negligence or wilful misconduct,
- statutory data protection violations under applicable law, or
- any other liability that cannot be excluded or limited by the law of your jurisdiction.
Indemnification
You agree to indemnify, defend, and hold harmless GoGuru and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of GoGuru
- Your violation of these Terms
- Your violation of any law or third-party rights
- Any data you enter into GoGuru, including student data
- Any WhatsApp messages you send using the reminder feature
- Any dispute between you and a student, parent, or other third party
Termination
Termination by you
You may stop using GoGuru at any time. You can delete your account from within the app (Profile → Settings → Delete Account). Upon deletion, your data will be permanently removed within 30 days as described in our Privacy Policy.
Termination by GoGuru
We reserve the right to suspend or terminate your account at any time if:
- You violate these Terms
- Your use of GoGuru is causing harm to other users or to the service
- We are required to do so by law
- We decide to discontinue the GoGuru service
In cases of serious violation (e.g. storing false student data, abusing the reminder feature, attempting to access other users' data), we may terminate your account immediately without notice.
In other cases, we will give you reasonable notice and an opportunity to address the issue before termination.
If your account is terminated and you believe the decision was made in error, you may contact us at [email protected] within 30 days of termination to request a review. We will consider the appeal in good faith and respond within a reasonable time.
Effect of termination
Upon termination, your right to use GoGuru ends immediately. We will delete your data as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Sri Lanka.
Any dispute arising from these Terms or your use of GoGuru shall first be attempted to be resolved through good-faith negotiation. Contact us at [email protected] with the subject "Dispute" and we will respond within 14 days.
If the dispute cannot be resolved through negotiation, it shall be submitted to the jurisdiction of the courts of Sri Lanka.
Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last updated" date at the top of this document
- We will notify active users by email at least 14 days before the changes take effect
- We will display a notice in the GoGuru app
Your continued use of GoGuru after the effective date of the updated Terms constitutes your acceptance. If you do not agree with the changes, you must stop using GoGuru and delete your account before the effective date.
Miscellaneous
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoGuru regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, restructuring, or sale of all or substantially all of the GoGuru business. Any transfer of personal data as part of such a transaction will be carried out in accordance with applicable data protection law, and you will be notified by email at least 30 days in advance of any such transfer.
